Former-Cop Exposes How Police Will Violate Your Rights During Every Stop & How to Beat It


“They have made this system convenient to allow your rights to be violated in a way that you would much rather have that happen than stand up for them.”

That’s how Eddie Craig, former Deputy Sheriff, and current show host at Rule of Law Radio, describes the Transportation Code of Texas. It could be applied to traffic statutes of any given state, or maybe he is referring to the entire way in which law enforcement goes about its business.

And it really is a business, driven by revenue, but possessing the power of the State and with a license to kill. Law enforcement is a revenue collector, producing obscenities like civil asset forfeiture where cash and property are seized from innocent people on made up suspicions.

Craig appeared on the Tom Woods show to discuss how cops are trained to pry into people’s business during traffic stops, violating our rights to gain further admissions of guilt that may lead to a search or arrest.

“An officer’s first job when he gets you pulled over for a traffic stop is to attempt to escalate that stop to either a DUI or a drug bust. He doesn’t care about the traffic, that’s just his premise for pulling you over. His real goal is to get inside that car and see what else he can find.

They are taught to find ways to keep the person in the car talking and answering questions that will allow them to continue their fishing expedition.”

Craig himself never ticketed anyone during his time as a deputy sheriff. He only pulled people over who were driving dangerously, and if there was no criminal act then he would send them off with a warning to avoid dangerous driving.

Most of his former colleagues, however, are not so rational. They are true soldiers of the State, seeking a way into everyone’s privacy to feed the belly of government.

“Everything these officers do is meant to trick you into something that they can actually arrest you for,” said Craig of Texas law enforcement. In the Lone Star state, as soon as a cop puts his lights on to pull you over, you are in custodial arrest. You are treated as if in custody, and anything you say can be used against you.

However, you have the right to remain silent. “The more you say, the worse things will get,” said Craig.

For instance, in Texas one has the right to carry a gun in the vehicle while traveling. Even though it’s “none of his business,” a cop may ask if you have any guns in the vehicle. According to Craig, if you say yes, the cop will get you out of the car, take the gun and scan it. You are now linked to that gun, even if it’s not registered to you.

Craig cited the case of a female attorney, Rebecca Musarra, who declined to answer questions when she was pulled over by a cop in New Jersey. The cop responded by pulling her out of the vehicle and reading Musarra her rights, which includes the right to remain silent. The pending lawsuit could be a wake-up call to roadside rights abuse by police.

Hi, do you know why I stopped you?” This simple question often asked by a cop when pulling someone over is the first attempt to lure a person into an admission of guilt. If you continue to answer questions like “Where are you coming from?”, it is a sure way to put yourself in danger.

“Oh, were you drinking at this party? Were there drugs at this party? Do you have anything in the car that I should know about…that you should tell me about?”

These are some of the baits in the fishing expedition. The motto of “Don’t answer questions” is generally a good one in police encounters. And Craig reminds us, as always, to record all police encounters.

Craig encourages people to take civil disobedience a step further in his “Transportation Stop” action script. He described it during a mock stop between Tom Woods, the pretend driver, and Craig as the cop.

Make sure to pull over in a public space for your own safety, and acknowledge the pullover by waving or turning on emergency flashers. Do not incriminate yourself by answering questions; invoke your 5th Amendment right to remain silent if necessary.

This next part takes some more chutzpah and is controversial in that it could lead to irrational cops becoming agitated. Further clarification on the legal underpinnings is also necessary, as it relates to the precedence of state traffic code or federally guaranteed constitutional rights.

Craig says the right to remain silent includes the right not to produce anything that can be used against you in a court of law. He asserts that when a cop asks for your license and registration, instead of handing over the documents or refusing, you can say:

“Officer, can any of the information that you are demanding from me be used against me in a court of law or to potentially incriminate me in any way.”

The officer is obligated to tell you the answer, which is that he can indeed use the documents against you. Craig acknowledges that the law states you must hand over the documents, but he believes this is a violation of the 5th and 4th Amendments.

“But he didn’t tell you what your rights were, and now you can show this was not a voluntary surrender,” said Craig. “And that statement can later be suppressed at trial where he can’t use that info against you because it was illegally obtained.”

Some cops might actually just leave you alone. It’s hard to predict, but Craig said that if a cop refuses to answer or gets belligerent, you can say, “Officer, I believe that information can be used against me, therefore I invoke my right to remain silent. Do you intend to retaliate or punish me for simply protecting my right to remain silent?”

Not many people would be brave enough to take the situation that far. Unfortunately, it is easier to have your rights violated but refuse to answer questions, be on your way and pay the State extortion fee or traffic ticket. That is the point of the first quote in this article.

Too many cops like to take out their anger on vulnerable citizens, or they don’t know the laws they are supposed to enforce — or both. As Craig points out, police departments are allowed to intentionally hire lower intelligence people. Why?

The State needs order followers, not those who would question orders.

Craig says there is very superficial training of cops in understanding statutes, leading to a poor understanding of the law. Cops usually don’t know the law any better than the general public.

“Statutory schemes use terminology that sounds and looks very familiar, but the meaning assigned to that terminology is not the same you understand from common usage,” said Craig.

Regardless of your willingness to take Eddie Craig’s “Transportation Stop” Action Script to its full extent, the question of state traffic statutes versus federal constitutional rights is an interesting one.

Asking the following question could indeed be a paradox for the rare rational cop on the traffic beat.

“As a peace officer you are required to protect me and my rights. One of those is the right to remain silent.”

Breitbart’s Technology analyst Allum Bokhari has obtained a document (from a source within Facebook) which outlines their “process” of tracking an individual’s offline activity to determine if they should be labeled as a “hate agent.”

The document is called the “Hate Agent Policy Review.” It lists a “series of signals” which will establish whether or not one is worthy of this distinction. If your offline behavior meets their criteria, you may be “banned from Facebook.”

According to Bokhari, “these signals include a wide range of on and off-platform behavior.” Here are several examples cited in the document:

If you praise the wrong individual, interview them, or appear at events alongside them.

If you self-identify with or advocate for a “Designated Hateful Ideology.”

If you associate with a “Designated Hate Entity” (one of the examples cited by Facebook as a “hate entity” includes Islam critic Tommy Robinson).

If you have “tattoos of hate symbols or hate slogans.” (The document cites no examples of these, but the media and “anti-racism” advocacy groups increasingly label innocuous items as “hate symbols,” including a cartoon frog and the “OK” hand sign.)

If you possess of “hate paraphernalia.” (The document does not specify what this would include.)

For “statements made in private but later made public.” (Bokhari points out that “Facebook holds vast amounts of information on what you say in public and in private — and as we saw with the Daily Beast doxing story, the platform will publicize private information on their users to assist the media in hitjobs on regular American citizens.)

Paul Joseph Watson was designated as a “hate agent because he praised Tommy Robinson and interviewed him on his YouTube channel.” Others include conservative activist and writer Candace Owens, and conservative author and terrorism expert Brigitte Gabriel and British politicians Carl Benjamin and Anne Marie Waters. Regarding Benjamin, Bokhari explains:

The Benjamin addition reveals that Facebook may categorize you as a hate agent merely for speaking neutrally about individuals and organizations that the social network considers hateful. In the document, Facebook tags Benjamin with a “hate agent” signal for “neutral representation of John Kinsman, member of Proud Boys” on October 21 last year.

Facebook also accuses Benjamin, a classical liberal and critic of identity politics, as “representing the ideology of an ethnostate” for a post in which he calls out an actual advocate of an ethnostate.

According to the document, there are three tiers of hate speech. (Note: Facebookconsiders attacks on a person’s “immigration status” to be hate speech.”)

An individual will be determined to have engaged in hate speech “if they have made public statements, or statements made in private and later made public, using Tier 1, 2, or 3 hate speech or slurs.” Three instances of hate speech in one statement or appearance or five instances in multiple statements or appearances over one month will be considered a “hate signal.”

Other hate signals include “carrying out violence against people based on their “protected or quasi-protected characteristics,” attacks on places of worship, and conviction of genocide.”

This, unfortunately, is the world we live in.

One Nation Under House Arrest: How Do COVID-19 Mandates Impact Our Freedoms?

They saw all the consequences in the principle, and they avoided the consequences by denying the principle.”—James Madison

We have become one nation under house arrest.

You think we’re any different from the Kentucky couple fitted out with ankle monitoring bracelets and forced to quarantine at home?

We’re not

Consider what happened to Elizabeth and Isaiah Linscott.

Elizabeth took a precautionary diagnostic COVID-19 test before traveling to visit her parents and grandparents in Michigan. It came back positive: Elizabeth was asymptomatic for the novel coronavirus but had no symptoms. 

Now in a country where freedom actually means something, the Linscotts would have the right to determine for themselves how to proceed responsibly, but in the American Police State, we’ve only got as much freedom as the government allows.

That’s not saying much.

Indeed, it’s a dangerous time for anyone who still clings to the idea that freedom means the right to think for yourself and act responsibly according to your best judgment.

In that regard, the Linscotts are a little old-school in their thinking. When Elizabeth was asked to sign a self-quarantine order agreeing to check in daily with the health department and not to travel anywhere without prior approval, 

Instead of signing the blanket statement, 

I will do my best to stay home, as I do every other time I get sick. But I cannot comply to having to call the public health department everytime that I need to go out and do something. It’s my right and freedoms to go where I please and not have to answer to anyone for it. There is no pandemic and with a survival rate of 99.9998% I’m fine. I will continue to avoid the elderly, just like PRIOR guidelines state, try to stay home, get rest, get medicine, and get better. 

A few days after being informed that Elizabeth’s case was being escalated and referred to law enforcement, the Linscotts reportedly found their home 

“We didn’t rob a store,” Linscott said. “

That’s the point, of course.

In an age of overcriminalization—when the law is wielded like a hammer to force compliance to the government’s dictates 

Watch and see: just as it did in China, this pandemic is about to afford the government the perfect excuse for expanding its surveillance and data collection powers at our expense.

On a daily basis, Americans are already relinquishing (in many cases, voluntarily) the most intimate details of who we are—their biological makeup, our genetic blueprints, and our biometrics (facial characteristics and structure, fingerprints, iris scans, etc.)—in order to navigate an increasingly technologically-enabled world.

COVID-19, however, takes the surveillance state to the next level.

Except this isn’t exactly uncharted territory, is it?

It follows much the same pattern as every other state of emergency in recent years—legitimate or manufactured—that has empowered the government to add to its arsenal of technologies and powers.

The war on terror, the war on drugs, the war on illegal immigration, asset forfeiture schemes, road safety schemes, school safety schemes, eminent domain: all of these programs started out as legitimate responses to pressing concerns and have since become weapons of compliance and control in the police state’s hands.

It doesn’t even matter what the nature of the crisis might be—civil unrest, the national emergencies, “unforeseen economic collapse, 

It’s hard to know who to trust anymore.

Certainly, in this highly partisan age, when everything from the COVID-19 pandemic to police brutality to football is being recast in light of one’s political leanings, it can be incredibly difficult to separate what constitutes a genuine safety concern versus what is hyper-politicized propaganda.

Take the mask mandates, for example.

In other states, such as Virginia, the Nanny State is using more strong-handed tactics to force compliance with mask mandates, 

In Miami, “residents now risk a legal penalty if they venture into public without a face mask. The city has assigned at least 39 police officers to make sure that residents are following the city’s mandatory mask ordinance. Offenders will be warned but, if they refuse to comply, they will be fined. 

These conflicting and, in some cases, heavy-handed approaches to a pandemic that has locked down the nation for close to six months is turning this health crisis into an unnecessarily politicized, bureaucratic tug-of-war with no clear-cut winners to be found.

Certainly, this is not the first crisis to pit security concerns against freedom principles.

In this post-9/11 world, we have been indoctrinated into fearing and mistrusting one another instead of fearing and mistrusting the government. As a result, we’ve been forced to travel this road many, many times with lamentably predictable results each time: without fail, when asked to choose between safety and liberty, Americans historically tend to choose safety.

Failing to read the fine print on such devil’s bargains, “we the people” find ourselves repeatedly on the losing end as the government uses each crisis as a means of expanding its powers at taxpayer expense.

Whatever these mask mandates might be—authoritarian strong-arm tactics or health necessities to prevent further spread of the virus—they have thus far

In other words, the courts have concluded that the government has a compelling interest in requiring masks to fight COVID-19 infections that overrides individual freedoms.

Generally, the government has to show a so-called compelling state interest before it can override certain critical rights such as free speech, assembly, press, privacy, search and seizure, etc. Most of the time, the government lacks that compelling state interest, but it still manages to violate those rights, setting itself up for legal battles further down the road.

We can spend time debating the mask mandates. However, criticizing those who rightly fear these restrictions to be a slippery slope to further police state tactics will not restore the freedoms that have been willingly sacrificed on the altar of national security by Americans of all political stripes over the years.

As I’ve warned, this is a test to see how whether the Constitution—and our commitment to the principles enshrined in the Bill of Rights—can survive a national crisis and true state of emergency.

It must be remembered that James Madison, the “father” of the U.S. Constitution and the Bill of Rights and the fourth president of the United States, advised that we should “take alarm at the first experiment upon our liberties.

Whether or not you consider these COVID-19 restrictions to be cause for alarm, they are far from the first experiment on our liberties. Indeed, whether or not you concede that the pandemic itself is cause for alarm, we should all be alarmed by the government’s response to this pandemic.

By government, I’m not referring to one particular politician or administration but to the entire apparatus at every level that conspires to keep “we the people” fearful of one another and under virtual house arrest.

This is what we’ve all been reduced to: prisoners in our skin, prisoners in our homes, prisoners in our communities—forced to comply with the government’s shifting mandates about how to navigate this pandemic 

Right now, COVID-19 is the perfect excuse for the government to wreak havoc on our freedoms in the name of safety and security, but as It make clear in the book

Every revolution seeks to distort, tarnish, and destroy any sign of the positive accomplishments of the society they seek to replace.  During our own Revolution, our ancestors tore down statues of George III and melted them down to make bullets and cannons.  Therefore, it’s no surprise that during the current Democrat-led revolt the military wings of the party, BLM and ANTIFA, seek to desecrate and destroy the monuments raised by generations of patriotic Americans celebrating our shared culture. 

The first cases of this iconoclastic frenzy was aimed at heroes of the Confederacy.  The fact that they were slave owners is used as justification for their fall from the pedestal.  The same logic is applied to Washington, Jefferson, Madison, and others among our most prominent Founders and Framers.  Christopher Columbus is attacked for the crime of bringing Western Civilization to the Americas.  All of this has blazed across our screens.

Rioters senselessly deface and destroy historical sites, monuments, and statues

Now they are coming for President Lincoln because though he was anti-slavery for his entire public career and assassinated because he freed the slaves, he wasn’t pro-black enough for BLM.  And they have spread their attack to include General Grant who smashed the South and Teddy Roosevelt who built the Panama Canal and introduced America as a world power.  Where will it end?  It won’t until every vestige of the original American culture is eradicated, and statues of Marx, Field Marshal Cinque, Huey Newton, Bobby Seale, Malcolm X, and Nancy Pelosi fill every town square.  Make no mistake about it, this is not a crusade for social justice, this is a revolution to replace the old America with a new America. 

While Democrat leaders in Washington and around the country cheered the rebels on as the next step in their attempt to reverse the election of 2016, Republican leaders mostly stood silent wringing their hands afraid to do anything for fear of being labeled racists.  You’d think by now they would know that whatever they do they’ll be labeled as racists by the Deep State, its media propaganda arm, and their black shirted bullyboys in the street.  In stark contrast President Trump has stepped into the breach.   

Defining the situation and clearly describing the rebels our president said, “They’re tearing down statues, desecrating monuments, and purging dissenters. It’s not the behavior of a peaceful political movement; it’s the behavior of totalitarians and tyrants and people that don’t love our country.”  And clarifying his approach to justice in these cases of revolutionary vandalism by saying, “Long prison terms for these lawless acts against our Great Country!”

In recent weeks we have seen rioters senselessly deface and destroy historical sites, monuments, and statues. 

George Floyd riots/1619 project riots

Rioters have defaced and torn down monuments and statues honoring some of the most important figures in our Nation’s storied history. 
In Portland, mobs tore down statues of our Founding Fathers–George Washington and Thomas Jefferson. 
In San Francisco, rioters tore down a statue honoring Ulysses S. Grant. 
There are even calls to remove statues of Abraham Lincoln in Boston and Washington, D.C.
A statue of Hans Christian Heg, who died fighting for the Union Army during the civil war, was torn down in Wisconsin.
These monuments memorialize the history we all share as Americans, and they deserve to be defended for future generations.
The George Floyd riots/1619 project riots have now become the most destructive and expensive period of rebellion and mayhem since the Civil War.  Millions perhaps billions of dollars’ worth of property has been destroyed.  Thousands of businesses, many black owned, have been burned, looted, and closed ending the personal dreams of entrepreneurs and making their years of sacrifice and hard work fruitless.  If this lawlessness is allowed to continue it’s only a matter of time until America as we have known her is toppled from her pedestal along with Columbia and Lady Liberty. 

However, we can praise God that President Trump is fulfilling his duty to defend the life, property, and rights of the American people. 

President Trump will not tolerate the rampant violence and destruction that has occurred over the last 5 weeks. 
Left-wing extremists are rioting, looting, and calling for the destruction of the United States system of government. 
Through mob intimidation, these violent extremists are attempting to impose their ideology on the law-abiding citizens of this country. 
Some State and local governments are failing their citizens by not distinguishing between peaceful protest and violent chaos. 
Using the power of his office President Trump is not wringing his hands but is putting his hand to the plow and working to save our heritage from the ravenous wolves of revolution howling in the night.  Our President is taking action to defend our Nation’s historical monuments, statues, and memorials. 

Keep the Faith.  Keep the Peace.  We shall overcome

President Trump has signed an Executive Order that ensures that any person or group that destroys or vandalizes a monument, memorial, or statue is prosecuted to the fullest extent. 
United States law authorizes a penalty of up to 10 years imprisonment for the willful injury of Federal property. 
The Executive Order also directs that those who incite violence and illegal activity are prosecuted to the fullest extent under the law. 
State and local law enforcement agencies that fail to protect monuments, memorials, and statues will be subject to the withholding of Federal support. 
The Attorney General will take all appropriate action against individuals and organizations found to have participated in unlawful acts—related to rioting and the destruction of Federal property. 
The Federal Government will ensure personnel are available across the Nation to assist with the protection of Federal monuments, memorials, statues, and property. 
As his actions begin to take effect the President tweeted, “These arsonists, anarchists, looters, and agitators have been largely stopped.  I am doing what is necessary to keep our communities safe and these people will be brought to Justice!” 

Is America perfect?  No there’s nothing on this earth that’s perfect except for the love of God in and through Jesus Christ.  But even when we paint the picture, warts and all, America is still the last best hope of humanity for freedom.  Have we made mistakes, committed sins, and fallen short of God’s command to love the Lord our God with all our heart and soul and to love our neighbor as ourselves?  Of course, we have.  However, America is still the most noble experiment in self-rule and liberty in world history.   

Now is the time for all good citizens to come to the defense of their country.  We’re being assaulted from within.  The time to stand up for what we believe is here.  If we don’t stand for something, we’ll fall for anything. 

Keep the Faith.  Keep the Peace.  We shall overcome.

In a 5-4 Decision the United States Supreme Court has determined that California restricting church gatherings is not unconstitutional, and does not violate the “free exercise clause of the First Amendment.”  The Ninth Circuit Judges, regarding restrictions against churches regarding the free exercise of their religion, and more specifically, worship services, said, “constitutional standards that would normally govern our review of a Free Exercise claim should not be applied.”  The last time I checked, the First Amendment does not say, “Freedom of Religion, unless there’s a virus.”

The court’s decision is unconstitutional.  They are wrong.  Liberty must prevail.  And it is time the American People send that message.

We have allowed the tyrants in political office to run wild with their authoritarianism

In 1777 a small pox epidemic swept through the fledgling United States, and it occurred while we were fighting for our independence.  The British Troops had stronger immunity to the disease because its presence in Europe had been long standing.  In response to the disease, despite its 10% mortality rate, new United States offered a voluntary vaccine, quarantined the sick (not the healthy), and remained open for business and at war with the Redcoats through the disease’s journey along our shores.  While some precautions were taken voluntarily, the decisions were left up to the people, not through government mandate.

A little more than a decade later the Yellow Fever swept through Philadelphia, taking the life of the mayor, Samuel Powel, during the epidemic.  Powel, and his wife Elizabeth, had been given the opportunity by the George Washington family to wait out the disease at their home on Mount Vernon in Virginia in the name of safety, but the Powel couple felt their presence as a firm voice of leadership in Philadelphia was more important.  Some people died, most survived, and liberty was never compromised during the affair.  After the Yellow Fever departed, the immune systems of the Americans grew even stronger, and the country continued on to become the greatest this world has ever seen.

Now, we face a novel coronavirus that, if you honestly look at the numbers, has a survival rate of over 98%.  The death numbers have been padded, and we have been told a massive spike in cases has gripped our country, but interestingly enough the number spiked as testing increased.  In other words, due to testing, we don’t have more cases, we simply have more cases we know about as a result of the testing.

This mild virus has, honestly, killed some people, but largely those who have underlying health issues already in place.  But, for the most part, it is nearly harmless, and usually asymptomatic, to anyone under 60, and is a slightly stronger bug for those over 60.  As a result of a minor virus, we have refused to trust our immune systems, gone against science with “run and hide” strategies, we have shut down our economy, and worse, we have allowed the tyrants in political office to run wild with their authoritarianism.


Despite the Supreme Court’s ruling, it is time for churches to stand in defiance
We have complained, we have yelled, and we have taken them to court, and the dictators continue to do the evil things they do without any consequence.

The time for that stops now.

Remember how proud we were of the rise of the Tea Party Movement when President Obama’s policies threatened our Liberty?  We rallied, we shouted, and we were rewarded with a caucus in Congress, and with the election of a President named Donald J. Trump who has shown us that he has an incredible ability to stand firm, with a resolve of steel.

Have we learned nothing from him?

Dr. Martin Luther King Jr. did more than complain and form rallies.  He committed civil disobedience to ensure that the Civil Rights Movement moved forward and got national attention.  Should we not be doing the same in the face of this moment in history when tyrants are stomping all over our liberty?

Despite the Supreme Court’s ruling, it is time for churches to stand in defiance.  They need to unite, and hundreds of churches around California, and thousands around the country, need to openly hold worship services, regardless of what the ruling elite is mandating.

We also need to hold “face parties,” where those of us who refuse to wear masks visit public locations in groups to get our point across.  Target liberal businesses, government facilities, and the lobbies of media outlets freaking out about the Wuhan Chinese COVID 19 virus.  First, one person walks in without a mask.  As the person who thinks they are security for the establishment tells the person they need to have a mask on, another unmasked person needs to walk in.  Then another.  Then another.  Do it until the whole place is full of people not only not wearing masks, but hugging and talking and shaking hands with each other.  Let them arrest the whole group, if that is what is necessary to get media attention, and the attention of the American People.

That’s the rub.  You must have the stomach for civil disobedience.  You must be willing to take a risk that may include arrest, or worse.

I will wrap up with this little story to help you understand the perspective we need to be having.

In 2016, I had a Trump/Pence sticker in the window of my car, and a woman said that I was brave, and she would not do the same because she feared someone scratching her paint job on her car by running a key along the side of it if she put a similar bumper sticker on her vehicle.

“Think about what you just said,” I responded.  “The Founding Fathers put on the line their lives, their fortunes, and their sacred honor, and you are worried about a paint job.”

Liberty deserves better.  It is time for civil disobedience.  It is time for us to risk more than just a paint job on our car.  But, to make it work, WE must organize, and WE must do it.  Otherwise, we cease to be We the People, and we become, “those who once enjoyed liberty, but threw it all away to be in bondage in the name of good intentions and a virus.”

is the People


What they didn't tell you in school While we were being indoctrinated and forced to conform and let us not forget that To force another to consent is terrorism by definition

In school you were taught that the Government has three branches, the Legislative branch, the Executive branch, and the Judicial branch. The Legislative branch is the Congress and they make the laws. The Executive branch is the President, who runs the daily business of government. The Judicial branch is the Courts who interpret the law and determine of laws are constitutional. These are the three branches of government you were taught in the government-controlled schools. But there is a fourth branch of government, and that's the People.

People before Lawyers Some would argue that the People are not a branch of the Government. They would argue that we have a government that is of the People, by the People, and for the People. They would argue that through voting that the Government represents the People and that the Government is the People. In theory, and in an ideal world, this would be true. And for the most part it is true. But there are time when the Government does not represent the People and that the interests of the Government are not the interests of the People. There are times when the People have to assert their will directly and overrule the Government and assert the supremacy of the will of the People over the will of the Government.

The Government Exists for the Sole Purpose of Serving the People, not Ruling the People

The supremacy of the People is preserved throughout all the documents and papers used in the formation of the Government by the People. The preamble to the United States Constitution states, "We the people of the United States, in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the United States of America." Clearly the Constitution was created to form a government who's sole purpose was to serve the People and for no other purpose. The founding fathers went to great pains to ensure, through the separation of powers and the balance of power that no branch of government would ever become dominate and become a force that rules the People rather than serves the People.


The History of Democracy

America was originally a colony of England, which was a monarchy controlled by the King. Although England is still a monarchy technically, the Queen is little more than a tourist attraction and serves merely to feed the tabloid press industry. But 250 years ago the King was very powerful and America was settled by people who were trying to put distance between themselves and the King and his Church of England. America was settled by people who were seeking Liberty and Freedom. We became a People and we resented being subservient to the Government and the King and we dreamed of an America where the People were the King.

On July 4th 1776 the Second Continental Congress, representing the 13 states unanimously issued the Declaration of Independence. This document was the official notice given to the King of England that the 13 states were separating themselves from the Crown in order to form a government of the People. The Declaration of Independence is an important document and in many ways is as important as the Constitution. The Constitution is the document that establishes a government of the People by the People, and for the People. The Declaration of Independence is the document that establishes the supremacy of the People over the Government and establishes the Right and the Duty of the People "to throw off such Government, and to provide new Guards for their future Security."

The Declaration of Independence establishes the supremacy of the People and the Right and Duty to defend the Rights of the People over the Acts of the Government.

Our Constitution provides for as many protections as possible to ensure that the Government is subservient to the People and only exists for the purpose of serving the People. However, should these protections fail it is up to the People to rise up against the Government and to put the Government back in it's place. In this capacity, the People act as the fourth branch of government to take control and to override their decisions that violate the Fundamental Rights of the People to Life, Liberty and the Pursuit of Happiness.
By what means do the People exercise their authority over the Government? That depends on how resistant the Government is to complying with the Will of the People. In the case of the Declaration of Independence, it meant declaring war on the Government and overthrowing them. This is obviously a last resort after taking other steps less harsh. But clearly the Right and the Duty to overthrow the Government in order to restore the United States as a government to serve the People is clearly established in historical precedent.

The People Exercise their Powers

There are several examples where the People have risen up against the Government in order to reestablish the supremacy of the Will of the People over the interests of the Government. The most memorable event in recent history is the Vietnam War. The Government got us involved in a useless war and got stuck there. It was a war that was clearly wrong, the People didn't support the war, and the Government refused to serve the interests of the People and allowed themselves to be controlled by the interests of those who were profiting from the war. In fairness, there was a national pride factor involved as well. America wasn't ready to admit that we were wrong and to conceal the truth from the People. It was a time when the Government served it's own interests and the interests of people who put their personal profits ahead of the good of the people.

In this case the people rose up against the Government and we fought them. We protested, we rioted, we broke the laws, and we forced the Government to be subservient to the People and to get out of Vietnam. We put the Government back in its place to serve us, and not to rule us. We let the Government know that they can not order us into battle to die against our will to fight a war that served no public purpose.

When the Government violates the Constitution, it is the duty of the People to rise up against the Government to bring the Government into compliance with the Constitution.

On a local level, here in Springfield Missouri, the City Council decided to take the farm of a farming family, who had a well run dairy farm, for the purpose of building an industrial park. The location of the park was chosen so as to be inside the city limits so that Springfield Schools would get the taxes instead of Strafford Schools. Legally, the City had the powers of Eminent Domain to take the land. There was no procedure to stop the City from running the farmers off this 100-year-old family farm. But the People rose up against the City Council and through the shear force of will the People let the City Council of Springfield Missouri know that the People, acting as the 4th branch of Government, were going to prevent it from happening.


Powers and Responsibilities of the People

Maintaining the Government is much like maintaining your lawn. Although the plants in your back yard bring you joy for the most part, they have to be weeded and pruned to keep them growing the way you want. We try to make the Government self pruning and self weeding, but the Government isn't perfect and We the People have both the Power and the Responsibility to maintain our government in a manner that best serves the People in the pursuit of Life, Liberty, Freedom, and Happiness.

The first duty of a Citizen is to be personally involved in government. This means that voting is a requirement. And not just voting but going to the trouble to understand the issues and make a well reasoned decision. Getting good people into office is the first step in protecting the Rights of the People. I would go as far to say that failing to vote is a Sin against the Constitution. If I had my way I would make it a law that every voter got a receipt for voting and that you would get $10 off your taxes for every election you have a receipt for.

Citizens also have a duty to fight and report public corruption. This includes a duty to ensure that the government institutions that control corruption actually do something when corruption is reported. Government corruption can not be accepted because if you let them get away with it, then it becomes a pattern and cover-up becomes the norm. When the government breaks the law then there is no law.


The Imperative of Judicial Integrity

In the famous Supreme Court case of Elkins Et Al. v. United States, 364 U.S. 206, 80 S. Ct. 1437, 4 L. Ed. 2d 1669 the court in speaking about the imperative of Judicial Integrity stated: "In a government of laws," said Mr. Justice Brandeis, "existence of the government will be imperiled if it fails to observe the law scrupulously. Our Government is the potent, the omnipresent teacher. For good or for ill, it teaches the whole people by its example. Crime is contagious. If the Government becomes a lawbreaker, it breeds contempt for law; it invites every man to become a law unto himself; it invites anarchy."

Although I agree with Justice Brandeis for the most part, I'm not sure the term "invites anarchy" is the most accurate description of what judicial corruption invites. When you look at the People as the fourth branch of government then it is more accurate to say that judicial corruption invokes the responsibility of the People to take whatever steps are necessary in order to bring the Judiciary into compliance with the Law.

The United States Judicial System is little more that an organized crime ring for Lawyers to use the Power of the Government to Oppress and steal from the People.

The Checks and Balances in the Constitution contemplates three branches of government with the ability of any one branch to have the power to ensure that the other branches comply with the law and that the Government serves the People. Unfortunately, the Judicial Branch of the Government has opted out of the Checks and Balances system to be self regulating. This clearly is not working. Although it does maintain independence of the Judiciary, it also puts lawyers and judges above the law. Or courts are no longer our courts anymore. Judges and lawyers are little more than an organized crime family who have invaded our courts and impersonate judges and create the mere illusion of a Justice System that is completely void of all forms of Judicial Integrity.
Enforcing Judicial Standards on judges is impossible under our current system. Although they have their Rules, they have the ability to break their own Rules and they are not subject to enforcement. How can you take judges to court when judges control the courts? Judges know they can get away with anything and therefore they do. And their dishonesty is contagious and the Government has been the teacher of the People and has affected and undermined the basic integrity of People in Society. People follow by example, and a criminal Judicial System has led to criminal behavior in the People.

Self Regulation of the Judicial System violates the checks and Balances system of the Constitution

The Judiciary has stolen the ability to be safe within a marriage and a family in America. Our divorce courts are dens of thieves where lawyers loot families under the authority of the Courts and the Government. Lawyers stalk families as predators looking for an opportunity to move in and destroy the lives of the People for profit and using the authority of the Government to rob the People and to make them give up all their property to lawyers to protect their children from the Government.
These abuses of the Judiciary are so serious as to rise to the level of Treason to the Constitution and to invoke the duty of every citizen to do whatever it take to rid our government from this force that has invaded our Judicial System in order to rid ourselves of this enemy from within and to restore the Rule of Law to our courts which are here to serve the People and not the self interest of the Bar or the Government.

Loving your Country by Burning the Flag

There are those who are greatly offended by Burning the Flag. And they have a right to be offended. However, Burning the Flag can and should be an act of Patriotic Duty. Our soldiers did not fight and die to defend the Flag. They fought and died to preserve our Freedoms, Liberties, and Rights, including our right to Burn the Flag. The Flag is merely a piece of cloth symbolizing the Government. The respect shown the Flag is the same as respecting the Government.

Burning the Flag is an act that reminds the Government that the People are the Masters and the Government is the Servant. It let's the Government know who works for whom.

There are those politicians who waive the Flag while reaching into your pocket to steal your money or take away your Freedoms using the Powers of the Government to commit evil acts upon the People. Many of these same people are the ones who want to outlaw Flag Burning. Often this issue is used to distract you from noticing that he's taking bribes from Tobacco Companies selling them a license to market an addictive drug to the public. To me, that is a lot bigger crime against the Flag than a person burning it to protect the Rights of the People is.
Burning the Flag, and the Right to Burn the Flag are very important to the preservation of our Rights as a People to control the Government. The act of Burning the Flag is an act asserting that the Rights of the People are superior to the Powers of the Government. To be prohibited from Burning the Flag is the Government asserting that the Powers of the Government are superior to the Rights of the People. I agree with the Supreme Court that it is unconstitutional to prohibit Burning the Flag. The very act of Burning the Flag is a message of defiance to the Government and reminding them in the crudest way possible that the People are the Masters and the Government is the Servant.

Burning the Flag is an Act of Patriotism. People who care about America Burn the Flag.
I would rather see people Burn Flags over causes I don't agree with than to not see any Flag Burning at all. When the Government gets out of line and starts oppressing the People, it is the duty of every patriotic citizen to Burn the Flag and to stand up to the Government so as to preserve our freedoms and the Liberties for the People that our soldiers gave their lives to protect.


The People's Duty to throw off Oppressive Government

The people are the ultimate protector of our constitutional rights. We are the branch of government of last resort. When the government fails to abide by the Constitution and takes away our rights then it is ultimately the duty of the people to stand up to the government and take our rights back. This is not something that should be taken lightly. It is only in the most extreme of circumstances when all else has failed. However, as the judicial system of the United States continues to deteriorate into despotism, the time has now come to begin to talk about the possibility that there exist no other way to make the courts comply with the Constitution other than the direct intervention of the people.

Like the war in Vietnam, the people might have to rise up against the judiciary and make them comply with their own rules and ethical standards. I hope the judiciary reads this an realizes that the people are not kidding when it comes to insisting that judges and lawyers are not kings and are here solely to serve us and not to rule us. When, for example, the rules of court say that orders of the court and judgements shall be signed by the judge, and the Judges of the Missouri Supreme Court refuse to do so, they are committing treason to the Constitution and need to be removed from office.

The Declaration of Independence states:

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. --That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, --That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness. Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes; and accordingly all experience hath shewn, that mankind are more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed. But when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security.
Our right to justice is not something that the judiciary should play with. Our justice system is not a tool of self serving lawyers to use to allow lawyers to take advantage of the misfortunate and victimize them. Our courts are to serve the people and not as a profit center to protect the incomes of lawyers. We the people hereby give notice to the judiciary that you are acting in contempt of the people and that you will refrain from continuing to do so or face the consequences.


A man is either free or he is not. There cannot be any apprenticeship for freedom,“You can not be so blind with patriotism that you can't face reality.

“I’ve had enough of someone else’s propaganda… I’m for truth, no matter who tells it. I’m for justice, no matter who it is for or against. I’m a human being first and foremost, and as such I’m for whoever and whatever benefits humanity as a whole.”

“No, I’m not an American. I’m one of 122 million poor people who are the victims of Americanism. One of the … victims of democracy, nothing but disguised hypocrisy. So I’m not standing here speaking to you as an American, or a patriot, or a flag-saluter, or a flag-waver – no, not I! I’m speaking as a victim of this American system. I don’t see any American dream; I see an American nightmare!

“When I am dead--I say it that way because from the things I know, I do not expect to live long enough to read the book I have been writing  in its finished form--I want you to just watch and see if I'm not right in what I say: that the establishment, in its press, is going to identify me with "hate" or one seeking violence . it will make use of me dead, as it has made use of me alive, as a convenient symbol, of "hatred"violence--and that will help the establishment escape facing the truth that all I have been doing is holding up a mirror to reflect, to show, the history of unspeakable crimes that the establishment has committed against the human race.”

Just keep in mind this statement it rings all to clear “We're all fools," all the time. It's just we're a different kind each day. We think, I'm not a fool today. I've learned my lesson. I was a fool yesterday but not this morning. Then tomorrow we find out that, yes, we were a fool today too. I think the only way we can grow and get on in this world is to accept the fact we're not perfect and live accordingly.”
