The Present State of the U.S. Constitution
The Present State of the U.S. Constitution
I personally believe that the American Constitution is the single most brilliant political document ever written. It was written by men who were much more educated than most today, and they were liberally educated. Many spoke Greek or Latin. They had studied the philosophers. They had studied political systems. They had known tyranny, and they created rules for the government that they created. They created a system of checks and balances to ensure that power was spread among the three branches of government. The brilliance of the Constitution is that it recognizes that human nature is immutable. They understood that all governments earlier than their own time were tyrannical, and that the usurpation of power by governments had always been the norm.
They created a system to ensure that the “Creature” that they created would be constrained from the expansion of power. They believed, at the Federal level, “that government governed best which governed least.” Had we been wise enough to enforce the Constitution, we would not today be experiencing what can only be termed tyranny. Today the government interferes with our daily lives more intrusively that at any time in our history. The population that existed at the time of the American Revolution would have NEVER tolerated such tyranny. They revolted from Britain, at great cost, for usurpations of far less intrusiveness.
Ideas like “Common Core,” about which the left swoons, are tyrannical in nature. Education is not the business of the Federal government, and the Department of Education should be abolished. Common Core, in effect, seeks only to make us all the same. Sheep, easily cowed and dominated, and obedient. This is alien to American Political philosophy, which grants our right as individuals, to be left the hell alone.
There are those today who vilify the Constitution, almost always because it tolerated slavery. That is historical revisionism in its basest form. Right or wrong, at that time slaves were “property,” and the government had no legal authority, especially before it was even established, to essentially force people to abandon their own property. Most, even those who owned slaves, also fully realized that slavery was an abomination, but they were themselves slaves of their own time. If one is naive enough to not understand the power of the ways of one’s time, he has only to look at the way in which political correctness has enslaved the white population of America today. Freedom of thought and speech no longer exist in America. The opinions of the left are enforced, mostly by social stigma, but not entirely. The laws against hate speech, for instance, fully illustrate this. (Look at the definition of hate speech on Wikipedia.) The left is intellectually upside down. They rely on public stigma to enforce political correctness, and yet they fail to understand that this is also the correct and legal way to eradicate such abhorrent behavior. Why? Because they “FEEL” that hate speech is wrong, and they are willing to disregard the First Amendment to eradicate it NOW. They are not willing to allow public stigma to mature and dominate, and their impatience constitutes a crime.
After the establishment of the Constitution, the subject of slavery could be legally addressed on the grounds that we are all created equal. It took some time, and a great war to right this wrong, but in the end it was recognized that slavery constituted tyranny in its worst form, and it was abolished. Lincoln’s Emancipation Proclamation was entirely Constitutional in that it adjudged that the right of all men to be free, a central tenet of the Constitution, overrides the personal property assertion of slavery, and made the ownership of one human being by another illegal.
Much of what the Federal government does today is patently unconstitutional. Any educated person who reads the Constitution will understand that. Unfortunately few do, mostly because they do not want to be confused by fact. They disagree with the Constitution, in that they believe in that big government should provide complete security for the people. They refuse to understand that, if enough want the Constitution to be changed, it can be. They should attempt to change it to their liking, but until it is changed, it is (or should be) the law of the land. These people seek to provide a “safety net” to ensure against failure, never realizing that the unintended consequence of this is that they also ensure against success. They, although they prefer to be called Progressives, are socialists. They fail to understand that socialism ALWAYS fails because it contradicts human nature. They view the world, not as it is, but as they think it ought to be. They prefer to not think, but to feel. Just law has nothing to do with emotion. It is completely impartial, and it recognizes the correctness of allowing people the power to decide for themselves how to utilize their own assets. The progressives would say that that statement disallows taxes, which of course is ridiculous. The Constitution gives the government the power to raise taxes, but only to accomplish those programs which abide by the Enumerated Powers.
The founders fully realized that self governance was only possible if the people were educated, informed, and moral. If they were, they would know what the Constitution stipulated, especially enumerated powers, and they would rise in righteous indignation if the government overstepped its authority. Davy Crockett, as an example, while in congress, was persuaded by the citizens of his district to oppose congress granting a lump sum payment to the wife of Stephen Decatur, pointing out that the congress had no authority to take money, extracted from citizens at gun point, and give that money to any individual. Unfortunately today, the general population of the United States is ignorant, uninformed, and immoral in terms of our traditional value system.
In actuality, I find it mindless that the left end of our political spectrum, as individuals, understand this. They would resist for example, being forced to personally pay money to any particular charity or organization, understanding on the personal level, that that is unjust. What if they disagree with the philosophy of that chosen charity? What if they were required to support the Right to Life movement? Shudder! They would be forced to go against their conscience, and they would resist. At the same time they believe it perfectly proper to force owners of marriage pavilions to host homosexual marriages against their conscience. These same people insist that the Federal government must have social programs like welfare, food stamps, etc. , the list is enormous, never understanding that these programs are exactly the same. They take money at gun point from one citizen, and give it to another. This is not the legitimate business of the Federal government.
The left opines that this is only justice, again denying what they know to be true on a personal level. This intellectual disconnect is astounding. No one is saying that these kinds of things might not need to be done, but the various States are not Constitutionally constrained from establishing whatever social mechanisms they feel correct, and it is up to their own people to either agree or override such proposal. Americans have always been generous. Such programs would be legal, and they would avoid the ridiculous and wasteful Federal bureaucracy which exists today. This bureaucracy supports, in quite some style, thousands of “Social Workers,” a completely vacuous profession by the way, who supposedly honorably administer these programs, which are in fact, widely corrupt.
Having said all this, it must be observed that we the people are willingly allowing the Constitution to lose the battle. We have experienced at least three generations of citizens so absorbed in their own affairs, that they forgot to safeguard there own freedom. Freedom is not free. It must be vigorously defended every day of our lives or it will be lost. The citizenry sat back and allowed those who thought they knew better than the people as to how society should run, to completely take over the educationl system, and to teach our children to be good and obedient socialists.
Today a huge proportion of the national budget goes for social programs that did not exist when Kennedy was President. These programs are a ponzi scheme. They can not be sustained financially, putting aside the tenet that they are unjust. They will bankrupt the country. The citizenry of the left may FEEL that these programs are correct, but do not think for one minute that those in power do not know these programs will bring our downfall. As with all socialist systems, the condition of tyranny is a given. How else can a government continue to get away with taxing the rich to benefit the poor, and always politically loyal, portion of society? They consider the idealistic and “touchy feely" citizenry of the left to be, in the words of Lenin, useful idiots. They know that giving away free stuff guarantees their reelection. They are getting their’s, and they are attempting to kick the can down the road long enough to see the end of their own watch. Beyond that, they don’t care. The country be damned, they will do what is politically expedient for as long as they can.
Since it is reckoned that more than 50% of the citizenry is today dependent upon the Federal government for at least a portion of their livelihood, it is likely that this can never be defeated. The Great American Experiment of self governance is seeing its last days. Our grandchildren will live in Tyranny, and sadly, it is our own fault. National suicide. The useful idiots will continue in their gaga, shiver down the leg, idealistic ways until the moment of truth, and they will be genuinely horrified with the results, but alas, it will be too late. At that point also, organized rebellion seeking to get change will be impossible. Even today, the HSD knows our every move. Surveillance is everywhere. How can the people under tyranny organize resistance under those conditions? Even to attempt such organization will result in a sudden knock on the door late in the night. If one thinks this cannot happen in America, they should consider that the Roman citizenry of the Republic, or the great majority of pre-WWII Germany felt the same way. Nations rise and fall, and we are failing. Very sad.
