Your Rights
Your rights are the rights of a sovereign.
By definition, “Sovereign” means “King”; that is to say, “A person, body, or state in which independent and supreme authority is vested; a chief ruler with supreme power; a king or other ruler.” (See: Black’s Law Dictionary 6th Edition.)
One might better describe, sovereignty, as, “agency with responsibility”.
Sovereignty comes from God. In the beginning, God created mankind in His own image, placed man on the Land and gave man: dominion, agency and possession. Respectively, Dominion, Agency and Possession are the three elements that define Sovereignty. What God created no man has the capacity to remove. Your sovereign nature simply exists; other than magnify it, there is nothing you can do about it. Contrary to popular patriot mythology (see: ), when you enter into a contract your sovereignty is not bound; instead, your sovereignty binds the contract. That is to say, your ‘sovereign will’ gives you the agency (capacity) to contract. Without sovereignty, you could not lawfully enter into a valid contract.
The ultimate will is the will of God, and God granted mankind free will, a.k.a. agency.
Therefore, man is his own free agent. And, respectively, man is responsible for his own thoughts and actions.
The famous phrase, "a government of the people, by the people, and for the people", means that in the United States of America, the Constitutional Republic form of government was set by the will of the sovereign people. This Republic was designed, not to govern the people but to provide for a central body of government that could lawfully apply the collective sovereign authority/ability of our nation’s people: to coin money, to regulate international and interstate traffic of goods and services, to promote the general welfare of the people, to better provide for a common defense of our nation from foreign encroachment and to secure the ability of the people to govern themselves and to protect their private land and property.
In this nation, other than God, there is no power greater than the will of the people. The sovereign people are constitutionally secured to their right to pursue: life, liberty, happiness and property to their heart’s content. However, today, people often discover problems when they try to exercise some of those rights. On review they discover a foreign power has gained control of the people through contractually secured relationships (see: 1935 Act’s purpose and its effect); which relationships are then used to imply the force of the government’s will over the people.
Though we still see advertisements about the “Land of the Free” and about the necessity we have to defend that freedom and liberty. The powers that be so advertise to show that people from all over the world came here and became free. Though it is true, the people that still come here, have far greater freedom than they did whereever they came from, that does not mean that they are free today. The difficulty in standing free with our rights is that most people neither know what their rights are nor what the laws are that secure those rights. Thus, the key to restoring our nation to its Constitution (law) is we must discover, learn or relearn what our rights are by learning the law and our history.
Because, after creating mankind and granting us sovereignty (dominion, agency and possession) and giving man the command to with it: “Be fruitful, and multiply, and replenish the earth, and subdue it’, our Creator instructed us to "Take dominion.” In other words, given that "Dominion" is synonymous with "Land", our Creator first instructed us to take the Land; wherefore, we will start here with Land rights.
In this nation, people (sovereigns) obtain ownership of land by Land Patent (the Title to land). When a sovereign is on his own land, he is a king in his own country. Other than God, there is no ruler higher. The Land Patent brings king and country together with liberty. Such ownership is called "Allodial", which means, 'beholding to none other' (that is to say, the opposite of feudal). Government has no authority over a man on his Land Patent secured Land. In proof of this fact, read the Land Patent that secures such rights to you; the verbiage is absolute. Also, remember the Law of Trespass, which says, if anyone enters the land without the sovereign’s permission that person is guilty of trespassing (an act of war between sovereigns) and is subject to summary execution on sight without any other cause or review. Other property rights are directly related to Land rights and the right to Land (Dominion) and property are the very foundations of virtually all other rights.
With that, we expect there will be people that will, inevitably, take off on the tangent of the patriot myth that falsely alleges a sovereign’s real estate is unassailable to debt or taxes. To avoid assuming that myth, please review our article on Land Patents; where you will learn that "Land" and the "property appurtenant to land" are two distinctively different things. "Land" is intangible and is synonymous with "Domain"; as such it cannot be bought sold or traded. Real Estate and or the property appurtenant to the land is tangible and can be bought sold and traded wither with a grant of related land or without the same.
A sovereign permitted to enter on some other sovereign’s land is merely a tenant, subject to the sovereign over the land. Tenants on the land are always bound to the law of the sovereign of the land. Thus, the authorized visiting sovereign limits his agency by a Tenancy Agreement (contract), which allows his entry upon and or use of the land that is not his. All other property rights stem from land rights. People tend to forget about their sovereignty as they bind themselves under more and more contracts.
When sovereigns do not have sufficient ability to acquire their own land, they may acquire assistance of some commercial entity (bank, etc.) to assist them with funding a purchase of property appurtenant to the land. Such acquisitions are almost always made by contract. Such contracts almost always secure the sovereign’s agreement to exclude the exercise of their rights over the land against the lender. To enforce such contracts the commercial entities request governmental assistance with enforcement and require the sovereign’s acceptance of the same before they ever close the agreement on the contract. Involvement with such contracts invites statutory controls, which ultimately tend to evolve governments into corporations. Notice that the authority to enforce a contract comes from the parties that enter the agreement.
These tendencies notwithstanding, it is a functional impossibility to lawfully remove man from either his sovereign ability or his respective responsibility (agency).
Though a sovereign can, by his sovereign word, bind himself to limit his ability to exercise his rights, it is impossible to contract ones sovereignty away. So, what happens when we grant our responsibility via contracts? Your sovereign responsibility holds you accountable to the terms of your contract. Wherefore, we each bear the respective burden to act like the sovereigns we are and so stand accountable. But some people have been tenants for so long that they do not remember what sovereignty is like. They do not know the Law. They have not even studied the statutes. And, respectively, they do not trust themselves when they are brought into accountability. Therefore, they hire lawyers and insurance companies to represent them in fictitious capacities; believing that will secure their ongoing exercise of commercial activities under contracts. They falsely tell themselves that they cannot stand on their own. The reality is, they cannot stand any other way—accountability does not shift to the hireling. Chief Justice Warren Burger is quoted to have said, “If you don’t know what your rights are you don't have any”; it's true.
Ultimately, all of your rights come from your sovereignty. Sovereignty is a gift from God. Everything God does lasts forever and someday each and every one of us will have the opportunity to stand accountable before God for our own sovereignty.
Imagine then pleading ignorance or a lack of trust, standing before God with an attorney, or insurance company representative, and saying that these will represent you.
The King of Kings will either say, “Get thee hence I know thee not”, or worse, “Get thee hence you knew me not.”
The bottom line: it is true that if you don’t know what your rights are, effectively, you do not have any; thus, to assert your rights you have to:
Know what your rights are;
Know through what the laws your rights are secured and/or applied; and,
Know how to lawfully apply the same.
