Here’s the NDA Hillary signed, outlining criminal penalties for mishandling classified material

By now, everyone knows that Hillary was running a largely unsecured email server out of her New York home.  We also know that hundreds of the emails that passed through that system contained classified information.  Now, thanks to the Washington Free Beacon,  we know that upon assuming her role as Secretary of State, Hillary signed a Sensitive Compartmented Information Nondisclosure Agreement (SCI). The document outlined her responsibilities in dealing with classified information, and made her aware of the criminal penalties associated with failing to meet them.

“I have been advised that the unauthorized disclosure, unauthorized retention, or negligent handling of SCI by me could cause irreparable injury to the United States or be used to advantage by a foreign nation,” the agreement states.

Clinton received at least two emails while secretary of state on her personal email server since marked “TS/SCI”—top secret/sensitive compartmented information—according to the U.S. intelligence community’s inspector general.

“But,” the dwindling numbers of Hillary faithful will say, “It was classified later! She didn’t know what she was doing! She is as pure as the wind-driven Scandinavian snow!”

Sorry, but according to the document, it was Hillary’s job to ascertain the sensitivity of data she emailed - whether it was previously classified or not.

The language of her NDA suggests it was Clinton’s responsibility to ascertain whether information shared through her private email server was, in fact, classified.

“I understand that it is my responsibility to consult with appropriate management authorities in the Department … in order to ensure that I know whether information or material within my knowledge or control that I have reason to believe might be SCI,” the agreement says.

The Clinton campaign did not immediately respond to a request for comment on the NDA.

Now, obviously, conservatives have known all of this for a while. What we didn’t have was confirmation that Hillary had, in fact, signed such a document. We also didn’t know the exact wording of the agreement. Given that several of the messages contain information that she clearly should have known was classified the moment it was created; this does not look good for the “inevitable” candidate.

Additional emails on Clinton’s server contained information that was “born classified,” according to J. William Leonard, who directed the U.S. Information Security Oversight Office from 2002 to 2008.

“If a foreign minister just told the secretary of state something in confidence, by U.S. rules that is classified at the moment it’s in U.S. channels and U.S. possession,” Leonard told Reuters in August.

Clinton’s NDA spells out stiff criminal penalties for “any unauthorized disclosure of SCI.” The FBI is currently investigating whether Clinton’s private email server violated any federal laws.

Worse, Hillary signed a separate document covering ALL classified info which specifically states: “I will never divulge classified information to anyone unless: (a) I have officially verified that the recipient has been properly authorized to receive it; or (b) I have been given prior written notice of authorization.”

Considering her correspondences with Sid Blumenthal, Cheryl Mills, and Huma Abedin, this could end up being a bigger problem.

Will her voters care? No. They’re not interested in whether or not Hillary broke the law. They assume she did, because she’s been doing it for decades, and they’ve decided they’re fine with it. They’re ready to put her in the White House anyway. Still, if you’re holding out hope that someone will enforce the law, this is the legal ground on which they’ll be standing.
